General terms and conditions Recreational Farm De Oorsprong

1 Application

1.1 These General Conditions apply to all offers, reservations and agreements relating to all accommodations, holiday homes, furnished tents, camping pitches and other facilities rented by Recreatieboerderij De Oorsprong.

1.2 In these General Conditions, the terms 'tenant' and 'you' mean: The person who enters into an agreement with Recreatieboerderij De Oorsprong regarding the rental/use of accommodation, holiday homes, furnished tents, camping pitches and/or other facilities. The term 'user' (hereinafter also referred to as 'guest') means: the renter and the persons specified by the renter who (will) use the rented accommodation and/or holiday homes, furnished tents, camping pitches and other facilities.

1.3 These Terms and Conditions apply regardless of your (prior) reference to any older or other (third party) terms and conditions. Recreatieboerderij De Oorsprong rejects all terms and conditions to which you refer or which are used by you. 

1.4 Agreements deviating from these General Terms and Conditions are valid only if agreed in writing.

2 Reservations

2.1 Recreatieboerderij De Oorsprong only accepts reservations from persons over the age of 18. Reservations by persons under that age are not valid.

2.2 Recreatieboerderij De Oorsprong reserves the right, without giving reasons, to refuse non-standard reservations, especially those made by students and sports clubs, or to impose special conditions.

2.3 If Recreatieboerderij De Oorsprong processes your reservation, Recreatieboerderij De Oorsprong will send you a confirmation, which is also the invoice, within 14 days of the booking. After receiving this, you should check it for accuracy. Any inaccuracies must be immediately communicated to Recreatieboerderij De Oorsprong.

2.4 If you have not received a confirmation/invoice within 14 days of making the reservation, you must immediately contact Recreatieboerderij De Oorsprong, failing which, no appeal can be made to the reservation.

2.5 An agreement is concluded between you and Recreatieboerderij De Oorsprong at the moment that Recreatieboerderij De Oorsprong has confirmed the reservation.

2.6 The agreement concerns rental of accommodation, holiday homes, furnished tents, camping pitches and/or other facilities for recreational use, which by its nature is of short duration.

3 Amendments to the agreement

3.1 If, after the conclusion of the agreement, you wish to make changes to the agreement, Recreatieboerderij De Oorsprong is not obliged to accept them. It is at the discretion of Recreatieboerderij De Oorsprong to determine whether and to what extent those changes will be accepted by it. In case Recreatieboerderij De Oorsprong accepts your changes, Recreatieboerderij De Oorsprong will charge you amendment costs. 

3.2 Changes of arrival date and/or location from 4 months before arrival are not allowed. In these cases, the cancellation fees as described in Article 13 of these General Conditions will apply.

3.3 If, after the conclusion of an agreement for more than one accommodation, holiday home, furnished tent and/or camping pitch, you wish to reduce your stay, the cancellation conditions as described in Article 13 of our General Terms and Conditions will apply. 

3.4 If, due to other circumstances, Recreatieboerderij De Oorsprong has to make a change in a booking made by you with regard to the location, (applies only to the accommodations in the farm) of the stay, Recreatieboerderij De Oorsprong can offer you a suitable alternative.

4 In-the-plate 

4.1 The lessee and other users are not permitted to give the accommodation, holiday homes, furnished tents and/or camping pitches, under whatever name and for whatever reason, to anyone other than the persons named in the agreement, unless otherwise agreed in writing with Recreatieboerderij De Oorsprong.

4.2 If you and Recreatieboerderij De Oorsprong have agreed that you and/or several users will be replaced, you will remain jointly and severally liable to Recreatieboerderij De Oorsprong, in addition to the tenant and/or users replacing you and/or other users, for payment of the part of the rent still due, the change costs (see article 3.1) and any additional costs resulting from the replacement and any cancellation costs.

5 Prizes

5.1 You owe Recreatieboerderij De Oorsprong the agreed rental price, as stated in the confirmation as well as the invoice of the reservation.

5.2 Price discounts and/or special offers can no longer be used after confirmation of the reservation/invoice has been sent by Recreatieboerderij De Oorsprong.

5.3 All prices are inclusive of VAT, where applicable, unless otherwise stated.

5.4 Recreatieboerderij De Oorsprong has the right to increase prices as a result of interim changes in legislation or provisions (including but not limited to VAT, tourist tax, insurance tax) on which Recreatieboerderij De Oorsprong has no influence.

6 Additional costs

6.1 You/the tenant will owe tourist tax charges in addition to the rental price

6.2 The tourist tax contribution is set by the Municipality of Schiermonnikoog. You/the tenant owe Recreatieboerderij De Oorsprong at all times the applicable tourist tax rate set by the municipality.

6.3 Additional charges are payable for the use of electricity at the camping pitch. This has a fixed rate per day. 

7 Payments

7.1 A deposit of 50% of the total amount payable must be paid within 14 days of making the reservation. For reservations made within 8 weeks before the day of commencement of your stay, the full amount must be paid at once.

7.2 The remaining amount of the rent should be received 8 weeks before the day of arrival at Recreatieboerderij De Oorsprong as mentioned in the confirmation of the reservation.

7.3 If the amounts invoiced to you are not paid on time, you will be in default immediately after the period for payment has expired. If (timely) payment is not made, Recreatieboerderij De Oorsprong is entitled to dissolve (cancel) the agreement. You are liable for all damages that Recreatieboerderij De Oorsprong suffers or will suffer, including all costs that Recreatieboerderij De Oorsprong has had to make in connection with your reservation and dissolution. In any case, Recreatieboerderij De Oorsprong has the right to charge cancellation costs per accommodation, holiday home, furnished tent and/or camping pitch. In this case, the provisions of Article 13 apply.

7.4 Recreatieboerderij De Oorsprong always has the right to set off claims against you for whatever reason against amounts payable by you for whatever reason.

8 Arrival and departure

8.1 The rented accommodation and/or holiday home can be occupied from 1.30 pm on the agreed day of arrival as stated on the booking confirmation. Exception: On Sunday this is 16.30 hrs. On the agreed departure day, as stated on the booking confirmation, the accommodation must be vacated by 10.00 a.m.. Exception: On Sunday it is 13.00 hrs. For a camping pitch, you can occupy your pitch from 13.00 on the agreed day of arrival as stated in the confirmation and the pitch must be vacated before 12.00 on the agreed day of departure.

8.2 If you wish to continue the agreement with Recreatieboerderij De Oorsprong for longer than the agreed duration, and Recreatieboerderij De Oorsprong agrees to this in writing, Recreatieboerderij De Oorsprong is always entitled to designate another accommodation/camping site.

8.3 If the use of the accommodation, holiday homes, furnished tents, camping pitches and/or other facilities is terminated earlier than the agreed date mentioned on the booking confirmation. The tenant is not entitled to a refund of (part of) the rental price and/or costs by Recreatieboerderij De Oorsprong. If you have taken out travel insurance and meet the conditions set by the insurance company, you can submit a claim for compensation for the early termination of your stay directly to the insurance company. 

9 Regulations

9.1 The guest is obliged to observe the house rules. Recreatieboerderij De Oorsprong is entitled to end the provision of services to guests at any time without notice if the guest or co-tenants repeatedly break the house rules. This without refund of deposit and rental amount. 

9.2 You must inhabit the accommodation, holiday homes and/or furnished tent housekeeping, be careful with our belongings and household goods.

9.3 The entire building and furnished tents are non-smoking. Outside by your own terrace, you can smoke. Please do not throw cigarettes on the ground, but tidy up. Also not in the grass.

9.4 The use of bed linen is compulsory. The use of sleeping bags is not permitted. If it is found that sheets etc. are not used, you are obliged to hire them from Recreatieboerderij De Oorsprong. And the duvets will be washed. These costs are also for you.

9.5 Not allowed is scratching or writing on walls, ceilings, tables, beds, chairs, etc. If this does happen, it amounts to full compensation (new value) of the damaged item.

9.6 Tape, drawing pins and the like are not allowed to hang things. Buddies or special painting tape are. You can pick these up at reception.

9.7 It is not allowed to take furniture, duvets, pillows, etc. outside. This also applies to all tables and chairs.

9.8 No cooking is allowed after 10pm. So not even at night. This is to prevent unnecessary fire alarms.

9.9 Music is allowed, provided it is not audible outside the accommodation. Your neighbours and other guests at Recreatieboerderij De Oorsprong should not be disturbed by you.

9.10 Pets are not allowed in all accommodation, holiday homes, furnished tents. No exceptions apply. Assistance dogs must be reported in advance, with appropriate information. We will contact the relevant organisation. Assistance dog? Then please clean the accommodation, holiday home and/or furnished tent extra well yourself. Recreatieboerderij De Oorsprong also charges extra costs for the dog.

9.11 Ball games only on the recreation field near the football goals and volleyball court. Please do not play on the terraces or near the stables.

9.12 Night-time quiet applies from 10pm to 8am. Go out in the evening... Stay yourself: Act sociable and go quietly to the accommodation, holiday homes, furnished tent, and or camping pitch. Think about other guests. They like peace and quiet. After 9.30pm, it should be quiet outside.

9.13 The night register must be completed on arrival and returned as soon as possible. Before 8pm.

9.14 Candles and tea lights only burn in the holders provided. This prevents burn marks.

9.15 Frying is not allowed in the accommodations, holiday homes and/or furnished tents.

9.16 Scented candles and incense may not be burned in accommodation, holiday homes and/or furnished tents.

9.17 In case of serious noise nuisance and complaints from other guests, Recreatieboerderij De Oorsprong will retain the deposit.

9.18 Fire alarm: on purpose? Fine €350 must be settled immediately. This amount is for the volunteer fire brigade on Schiermonnikoog which has to turn out for nothing.

9.19 Recreatieboerderij De Oorsprong reserves the right to make changes to the opening hours of the farm's facilities (courtyard, camping area, reception) including a partial or total closure thereof, without you being entitled to compensation.

9.20 To carry out necessary maintenance, you will allow work to be carried out on the accommodation or facilities during your stay without entitlement to compensation.

10 Pets

10.1 Pets are not allowed in all accommodation, holiday homes and/or furnished tents. On camping pitches, 1 dog is allowed per pitch. Declared in advance. You pay a fee for the dog per night.

10.2 Visitors' pets are not allowed.

10.3 Pets on the campsite must be kept on a leash at all times.

10.4 Pets are not allowed to walk in the meadows around the Recreation Farm. Due to transmission of diseases to our cows.

11 Use of accommodation; inventory

11.1 The tenant/user and those accompanying the tenant are each jointly and severally liable for an orderly state of affairs in and around the rented accommodation, holiday homes, furnished tent and/or camping pitch, and for the use of the accommodation, holiday homes, furnished tent and/or camping pitch and the equipment therein.

11.2 In addition, the tenant/user and those accompanying the tenant are always jointly and severally liable for damage caused by breakage and/or loss and/or damage of inventory and/or accommodation (also applies to holiday homes and furnished tents). Any damage must be immediately reported by the tenant to Recreatieboerderij De Oorsprong and immediately compensated on the spot, unless the tenant can prove that the damage was not caused by him, other users or one of the members of the group.

12 Deposit

12.1 For each booking, Recreatieboerderij De Oorsprong charges a deposit per accommodation, holiday home and/or furnished tent. If circumstances warrant (e.g. students and sports clubs) 

12.2 The deposit serves as a guarantee for damage and/or costs - in the broadest sense of the word - that Recreatieboerderij De Oorsprong may suffer if the tenant/user and those accompanying the tenant fail to fulfil their obligations.

12.3 If the deposit is not paid immediately, Recreatieboerderij De Oorsprong is entitled to deny the tenant and/or other users access to the accommodations, holiday homes and/or furnished tent.

12.4 If you fail to pay the deposit, Recreatieboerderij De Oorsprong is entitled to cancel the agreement with immediate effect. This without restitution of the reservation amount.  

12.5 The deposit or any remaining amount will be refunded to the tenant and/or users after settlement of claims (damage to inventory/accommodation and/or other costs) of Recreatieboerderij De Oorsprong. Any (further) claims for compensation will not be cancelled by this refund.

13 Cancellation fee

13.1 Within 14 days of making the reservation, the reservation can be cancelled free of charge unless the cancellation is made 30 days or less before the start of your stay. 

13.2 If a reservation is cancelled after 14 days of making the reservation or within 30 days before the start of your stay, a cancellation fee will be payable. These cancellation fees are 50% of the total amount if cancelled up to 30 days before the day of arrival and the full total amount if cancelled from the 30th day or later.

13.3 You can insure yourself against cancellation risks by taking out cancellation insurance together with your reservation. This is not possible via Recreatieboerderij De Oorsprong.

13.4 If you have not arrived within 24 hours of the agreed date without further notice, this is considered a cancellation (no show) In this case, you will owe the full total amount.

14 Force majeure and amendment

14.1 In the event that Recreatieboerderij De Oorsprong is, temporarily or otherwise, unable to execute the agreement in whole or in part due to force majeure, Recreatieboerderij De Oorsprong may, within 14 days after becoming aware of the impossibility of fulfilling the agreement, submit a change proposal (for other accommodations/another period etc.) Suspension of the fulfilment of the obligations by Recreatieboerderij De Oorsprong shall be permitted if circumstances beyond the control of Recreatieboerderij De Oorsprong arise. In no event shall Recreatieboerderij De Oorsprong be liable for any damages or costs.

14.2 Force majeure on the part of Recreatieboerderij De Oorsprong exists if Recreatieboerderij De Oorsprong is hindered in the execution of the agreement, in whole or in part, temporarily or otherwise, by circumstances beyond the control of Recreatieboerderij De Oorsprong, including danger of war, no sailing, pandemic, fire, floods and other disturbances or events.

15 Termination

15.1 Recreatieboerderij De Oorsprong has the right to cancel the agreement at any time, with immediate effect, if the personal details of you and other users are incomplete and/or incorrect when making a reservation. In such a case, there will be no refund of the rental fee or part thereof.

16 Liability

16.1 Recreation Farm accepts no liability for theft (including theft from accommodations, holiday homes and furnished tents), loss or damage of or to property or persons, of any nature whatsoever, during or as a result of a stay at our Recreation Farm and/or the rental/use of accommodation, holiday homes, furnished tents and/or other facilities of Recreation Farm De Oorsprong. Unless there is gross negligence on the part of Recreatieboerderij De Oorsprong.

16.2 Recreatieboerderij De Oorsprong is not liable for service failures or defects in services provided by third parties.

16.3 You/the tenant and each user is severally liable for all loss and/or damage to the rented accommodation, holiday home, furnished tent and/or other property of Recreatieboerderij De Oorsprong that occurs during its use by you and/or other users, whether or not it is the result of acts or omissions of yourself and/or third parties who are on the property with your permission.

16.4 You/the tenant indemnify Recreatieboerderij De Oorsprong against all claims for damages of third parties resulting from any act or omission of yourself, other users, your travel companions or third parties who are on the property with your permission.

16.5 In case of improper use or failure to leave the accommodation clean, including unclean accommodation, additional costs will be charged, which you are obliged to pay. Will be deducted from the deposit or we will send you an invoice for this afterwards. Final cleaning of holiday homes € 75 per house, Final cleaning of group accommodations € 45 per hour per cleaner. Final cleaning furnished tent € 55,= Final cleaning Dune tent € 22,50

17 Application law

17.1 The agreement between you and Recreatieboerderij De Oorsprong is exclusively governed by Dutch law.
